1. SCOPE OF APPLICATION / GENERAL

vivosan.ch is the online shop of Vivosan AG. The products and services offered by Vivosan AG are available exclusively within Switzerland and the Principality of Liechtenstein.

These General Terms and Conditions (hereinafter referred to as the "Terms and Conditions") apply to all services and products offered through vivosan.ch. Vivosan AG reserves the right to amend these Terms and Conditions at any time. Any such amendments shall take effect immediately upon publication.

2. REGISTRATION AND ORDERING

2.1 Registration

Registration with the online shop is available only to persons who have legal capacity. Registration is free of charge. There is no entitlement to registration or access to the online shop.

The customer must provide complete and accurate information during the registration process and is responsible for ensuring that this information remains up to date.

Users may request information about the personal data stored by Vivosan AG at any time and may request the correction or deletion of such data. Please contact us at info@vivosan.ch.

The customer agrees that all communication relating to orders, contracts, invoices and customer enquiries may be conducted electronically by email.

2.2 Placing Orders / Formation of Contract

Orders may only be placed online via the online ordering facility.

By submitting an order through the online shop, the customer makes a binding offer to enter into a purchase agreement in accordance with the provisions of the Swiss Code of Obligations (CO).

By placing an order, the customer also confirms that they are of legal age, that all information provided is complete and accurate, and that they accept these Terms and Conditions as an integral part of the purchase agreement.

Orders are acknowledged by email. Following receipt of an order, the customer will receive an order acknowledgement by email. This acknowledgement merely confirms receipt of the order and does not constitute acceptance of the customer's offer.

A purchase agreement is concluded only when Vivosan AG expressly confirms the order or dispatches the goods.

Vivosan AG reserves the right, at its sole discretion, to reject any order and refuse confirmation for any reason.

By placing an order, the customer confirms the accuracy of all information provided.

2.3 Delivery Charges

Delivery is free of charge for orders with a value of CHF 100 or more. For orders below this amount, a delivery charge of CHF 10 will apply.

All prices include the applicable Swiss Value Added Tax (VAT).

The prices displayed at the time the order is placed shall be binding.

2.4 Products

Vivosan AG reserves the right to limit the quantities supplied for certain products.

If a product ordered is unavailable at the time of dispatch, it will neither be invoiced nor delivered at a later date.

2.6 Partial Fulfilment of Orders

Vivosan AG aims to supply all ordered products in sufficient quantities and to the highest quality standards.

In exceptional circumstances, however, products may be unavailable or may not be released for dispatch for various reasons.

In the event of reduced quantities or non-delivery, the customer shall not be entitled to specific performance or compensation.

If an item has been invoiced but cannot be supplied, the corresponding amount will be credited to the customer. No subsequent delivery will be made and no claim for damages shall arise.

3. DELIVERY

3.1 Delivery of Goods

Goods will be delivered directly to the delivery address and contact person specified by the customer. Deliveries are carried out by DPD.

3.2 Delivery Times

Vivosan AG and DPD will make every reasonable effort to meet the stated delivery times.

However, all delivery times provided by Vivosan AG are estimates only. Failure to meet a stated delivery time shall not entitle the customer to withdraw from the contract or claim damages.

Should Vivosan AG be unable to fulfil an order that has already been confirmed, Vivosan AG shall not be obliged to arrange delivery by any alternative means. The customer shall have no entitlement to compensation in such circumstances.

3.3 Delivery Charges

Delivery charges depend on the selected delivery method and the value of the order.

3.4 Delivery Without Personal Receipt

Vivosan AG or its appointed carrier will endeavour to deliver consignments personally to the delivery address specified by the customer.

Where the customer has authorised the carrier to leave the parcel at a designated location, or where delivery is made in accordance with the carrier's applicable delivery conditions by leaving the goods at an agreed or otherwise suitable location, the delivery shall be deemed to have been completed once the goods have been deposited accordingly.

Upon proper delivery or deposit, all risks relating to the goods, including the risk of loss, theft, damage or adverse weather conditions, shall pass to the customer.

For addresses where home delivery is unavailable, the applicable delivery and deposit conditions of the relevant carrier shall apply.

3.5 Cancellation of Delivery by Vivosan AG

If successful delivery cannot be completed, or can only be completed under unreasonable circumstances for reasons beyond the control of Vivosan AG, including but not limited to an incorrect delivery address or the recipient's absence, Vivosan AG reserves the right to cancel the order.

In such cases, the customer shall have no claim whatsoever for specific performance or compensation.

This exclusion does not apply where a product was defective at the time of delivery. The customer's statutory warranty rights remain unaffected.

Such natural or manufacturing-related variations do not constitute defects and shall not give rise to any warranty or return claims.

Customers are responsible for following the manufacturer's care, cleaning, assembly and operating instructions.

Vivosan AG accepts no liability for damage or defects resulting from improper use, incorrect assembly, inadequate maintenance or failure to follow the manufacturer's instructions.
